Mediation Process

Consensio has developed a mediation process based on the facilitative mediation model that is focused, dynamic and effective. Our mediation services are delivered by highly experienced and accredited workplace mediators.

1.) The mediation referral process

  • A Consensio mediator will initially talk in confidence with the client referring the case for mediation to assess its suitability for mediation and to discuss the client's expectations.
  • Consensio will send the client a mediation referral form. Once completed, Consensio will allocate a mediator(s) to the case.

2.) Pre-mediation preparation

  • The Consensio mediator assigned to the case will have confidential telephone conversations with each party prior to meeting them on the day of mediation. The purpose of these initial calls is for the parties to be introduced to the mediator and for the mediator to answer any questions or concerns that the parties may have.
  • After this initial telephone call, the mediator will send the parties two documents: a pre-mediation questionnaire to help parties to think about what they would like to achieve from the process; and a mediation schedule to inform the parties of the mediation date and the scheduling of their individual and joint meetings.

3.) The mediation day(s)

  • In most cases, the Consensio mediator will work with parties face-to-face for a full day. Team mediation cases with multiple parties will take longer, depending on their size and complexity.
  • Individual meetings: The mediator will meet each party separately before the joint mediation session.

First individual meeting: The purpose of the first meeting is for each party to explain what has brought them to mediation. The mediator will help each party to explore the key issues relating to their conflict and allow each party to consider their goals for mediation. 

Second individual meeting: The mediator may hold a brief second meeting with each party to help them prepare for the joint meeting.

  • Joint meeting: During the joint meeting, the mediator will support the parties to communicate with each other openly, honestly and constructively. Whilst the mediator is responsible for the structure of mediation, it is the parties who are responsible for the content and outcome of mediation. The mediator will not make suggestions or recommendations to the parties.
  • Most mediations result in a signed agreement or action plan which the parties can employ in the workplace. The goal of mediation is to allow parties to resolve their conflicts in a safe and structured space.  

4.) Follow-up procedures with parties post-mediation

  • The mediator will support the parties after mediation on a regular basis. This is an important element to the mediation process as it helps the parties to (re-)establish a healthy and effective working relationship.
  • Consensio's follow-up procedures can be tailor-made to fit parties' needs. The parties may request another meeting with the mediator and/or regular telephone conversations.
